I think then the assertion of copyright in the website is simply not
sustainable and we can take the work. It might not be the most friendly
act, but it would be well within the law.

Personally I found the best approach to negotiations of this kind is to
take the text + run, create the module and then present it back - "see
what we can do with your module. We want to acknowledge you, obviously.
What do you think?"
